I am writing about my holiday pay for [the leave you are asking about].

My normal pay regularly includes the following on top of basic pay:

For at least the first four weeks of statutory leave in a year, holiday pay should reflect normal remuneration rather than basic pay alone. That principle comes from the Working Time Regulations 1998 and was confirmed for regular overtime in Bear Scotland v Fulton.

Could you please confirm how my holiday pay was calculated, and which elements of pay were included?

I am raising this to understand the calculation rather than to make a formal complaint at this stage.

What happens next

The rule applies to at least the first four weeks of leave. The remaining 1.6 weeks may lawfully be paid at basic rate.
A claim for unlawful deduction from wages must normally be brought within three months of the last underpayment.
